It also depends on the amount, if it is for a small amount I wouldn't even worry about it, or they could try to make arrangements, and pay this debt off. If it is large I would speak to an attorney and see what they should do. Go to First Call for Help, or Legal Aid society, and there are other agencys out there that will help the elderly for free. So there is help out there. Keep your head up.

Social Security can only be garnished for child support, IRS, student loans or other Fed government debts. If the only money put into a bank account is Social Security, the bank account can not be garnished.

The creditor could lien any real property. But not much else. Typically an elderly person on SS is pretty judgment proof. The credit really wasted time and money going to court for this judgment.

If they can't get it from a bank account...by the way, it is possible to garnish the deposits if it is deposited electronically....they can garnish tax returns. I am sure there is a way to garnish social security income as well. Being on a fixed income, even if it is social security, doesn't alleviate financial responsibility.

A judgment is put against property owned. If these people own a home the judgment will be paid at the time that the property sells. The elderly person will not be forced to sell the home. But the judgment will remain as a debt due until it is paid.
